Do you own an apartment in Warsaw and wonder whether you must pay maintenance fees in Warsaw to a cooperative or a community? The 2026 amendment to the housing cooperative law changed billing rules, and you should check your land register entry immediately.

What is the monthly bill for?

Owners do not pay “rent” to a third party. Consequently, they pay an operating charge or a management advance. Moreover, the money pays for stairs, elevators, the roof, and common plumbing. In addition, funds go to administration costs and the repair reserve. Therefore, you must pay these sums even if your flat stays empty.

Which legal regime governs your building matters a great deal. If your title reads “spółdzielcze własnościowe prawo do lokalu,” the cooperative still manages common areas. However, if the title says “odrębna własność,” a homeowners association (wspólnota) likely runs the building. Owners who created a wspólnota vote on budgets and advances. Consequently, a community must pass a resolution to set monthly advances. Moreover, you have six weeks to challenge such a resolution in court.

How did the 2026 reform change things?

The 4 December 2025 amendment, signed on 9 January 2026, increased transparency. Therefore, cooperatives must justify each fee rise. In addition, the law strengthened the rights of owners who are not cooperative members. However, the reform did not free everyone automatically from cooperative management. If not all owners converted titles, the cooperative can still charge fees under Article 4.

Costs, arrears and enforcement

Maintenance charges rose aggressively in Warsaw. For example, a Bielany flat paid about 350 PLN in 2020. Today, the same operating charge often exceeds 600 PLN. Moreover, spring 2026 brought another wave of increases nationwide. If you default, consequences escalate quickly. The cooperative or community can sue for payment. Consequently, courts may order forced sale in extreme cases. Furthermore, according to the National Debt Register, residential arrears topped 290 million PLN in 2023.

💡 GOOD TO KNOW: Check your land register number (KW) in the notarial deed. You can view the entry free at ekw.ms.gov.pl. In Poland, official IDs and institutions matter: PESEL is the national ID number, ZUS is the social insurance agency, and NFZ runs public health insurance. If the cooperative refuses to show a fee breakdown, request a general meeting. In addition, ask for a payment plan if you struggle financially. Finally, keep records of all notices, invoices, and court papers.

Do not ignore bills. Therefore, open a dialogue with the cooperative or community council early. Moreover, seek legal advice if you suspect unlawful charges. In addition, use the six-week challenge window for community resolutions.
