President signs law: up to PLN 100k tax-free gains

President signs law creating a Poland tax-free investment account allowing up to PLN 100,000 in annual tax-free capital gains.

The President signed a new law introducing the Ogólne Konto Inwestycyjne. The Poland tax-free investment account allows up to PLN 100,000 of annual gains exempt from the 19% capital gains tax.

Poland tax-free investment account: what the law does

Consequently, the law removes the so-called “Belka” 19% tax on capital gains for returns within the statutory limit. Moreover, the law sets the annual allowance at exactly PLN 100,000 per person. In addition, the law lets investors withdraw funds at any time without losing the tax-free treatment of gains already earned. Therefore, people do not need to wait until retirement to access their money. Furthermore, the law covers dividends from companies listed on the main market and NewConnect.

How the OKI works and why it matters

First, each resident with full legal capacity may hold only one account. Consequently, banks and brokerages will link accounts to a PESEL number and the national tax register. Moreover, institutions will apply a zero tax rate automatically, so investors do not need to fill PIT-38 forms. However, if yearly gains exceed the limit, the institution will tax the surplus at 19% at source. In addition, the account allows simple offsetting of gains and losses across asset types. Therefore, investors can compensate stock gains with bond losses in the same account.

Impact on Warsaw and the financial sector

Warsaw holds more than 520,000 individual brokerage accounts in the Mazovia region. Consequently, the capital will feel the policy most strongly. Moreover, brokerage houses around Rondo Daszyńskiego on Wola report record queries. In addition, advisors by ul. Książęca near the Warsaw Stock Exchange prepare education packages and ready-made bond-equity portfolios. Therefore, analysts expect at least PLN 3.5 billion to flow into OKI accounts in six months.

Supervision, penalties and practical safeguards

Moreover, the Financial Supervision Authority issued clear rules for providers. In addition, the tax administration launched automatic account registration checks. Consequently, anyone who hides another OKI or breaches deposit limits risks losing the whole tax exemption. Furthermore, the law allows penalties up to 120 daily rates for deliberate abuse. Therefore, compliance will remain strict.

💡 GOOD TO KNOW: As an expat you must hold Polish tax residency to open an OKI. PESEL is your national ID number and you often need it to register bank accounts. ZUS handles pensions and NFZ runs public health insurance. Consequently, bring proof of residency and your PESEL when you apply. In addition, providers will require a MiFID risk profile. Therefore, ask for plain language explanations of products. Finally, check whether your home country taxes foreign investment income, because Poland’s exemption may not remove all reporting duties.
