Driver in Lublin Remains in Custody After Fatal Crash

Suspect in the Lublin fatal crash stays in pre-trial detention until Sept 28 as prosecutors press serious charges.

Lead: A court has kept the suspect in the Lublin fatal crash in custody. Consequently, the 19-year-old remains in pre-trial detention until September 28.

Lublin fatal crash: what happened

The crash occurred at dawn on June 30 on Lipowa Street in Lublin. Moreover, investigators say a 19-year-old driver lost control of a BMW. He swerved into oncoming traffic and hit a properly driven Toyota head-on. As a result, a 17-year-old passenger in the BMW died. In addition, seven people suffered injuries. Authorities found the driver had alcohol in his system. Furthermore, he did not hold a valid driving licence.

Why the court kept him in custody

Judge Marta Śmiech confirmed the arrest order remains in force. The court concluded the evidence points to a high probability he committed the alleged act. Moreover, the court saw reasons to apply the strictest preventive measure. The judge noted a real risk the suspect might interfere with the investigation. Consequently, the court cited his familiarity with the victims. Therefore, judges feared he could influence witnesses or tamper with evidence. In addition, prosecutors stressed the potential for a severe sentence. The fatal charge can carry five to twenty years in prison.

Charges and legal process

Prosecutors charged him with causing a fatal road accident while intoxicated. They also charged him with driving under the influence. Moreover, the court applied temporary arrest, known in Poland as tymczasowy areszt. This measure prevents the suspect from leaving during the inquiry. However, the judge can extend the custody if needed. The detention currently runs until September 28. In addition, the prosecutor may ask for a longer period later.

Local context and enforcement

Road safety remains a major concern in Poland. Consequently, courts often use pre-trial detention in severe cases. Courts act strongly when deaths occur or many people get hurt. Moreover, Polish penalties for fatal collisions are strict. Therefore, legal outcomes can affect young drivers across the country.

💡 GOOD TO KNOW: If you are an expat in Poland, call 112 in an emergency. You can ask for an interpreter if needed. Keep your ID and PESEL (national ID number) handy for authorities. Note that healthcare works through NFZ (national health fund) and social issues go via ZUS. Also know that a “mandat” means a traffic fine. If involved in a legal case, contact your embassy and seek a lawyer fluent in English. Moreover, do not admit fault without advice, and document the scene with photos if it is safe to do so.
