ZUS plan to erase old social insurance debts

Government bill proposes automatic ZUS debt forgiveness of pre-1999 liabilities, freeing 7.1k payers and 315m PLN.

The government sent a bill to parliament that could wipe old liabilities from the books of the Polish social insurer. The measure targets legacy cases and promises automatic relief under ZUS debt forgiveness.

ZUS debt forgiveness: who benefits

The draft law covers debts that arose before 1 January 1999. It affects roughly 7,100 payers. Collectively the liabilities total about 315 million PLN. However, this is not a universal amnesty. Debts from recent years will not qualify. Consequently, most ordinary contributors and recent employers will see no change.

How the automatic write-off will work

The government adopted the proposal in cabinet on 11 August 2026. The bill received print number 3010 and now sits with the Sejm. Therefore, the measure is not yet law. When enacted, ZUS (Social Insurance Institution) should cancel debts by law. Moreover, the cancellation will happen without the payer filing any application. ZUS will notify people on their PUE profile. PUE stands for Platforma Usług Elektronicznych. In addition, ZUS will send a paper notice to the last registered address for those without a PUE profile. The write-off will also erase related interest and enforcement costs. Consequently, long-running enforcement cases will be closed.

Why the government wants to cancel 315 million PLN

The cabinet argues the recovery effort costs more than it yields. Officials estimate ten more years of enforcement would cost about 135 million PLN. Meanwhile predicted recoveries would reach only about 13.9 million PLN. Therefore, pursuing these debts would be uneconomic. The government also wants ZUS staff and resources freed. In addition, officials hope ZUS can focus on collecting newer liabilities. That would likely improve overall recovery rates.

What expats should do now

If you lived or ran a business in Poland before 1999, check your ZUS account. Your pension rights may depend on historical contributions. In particular, “kapitał początkowy” (initial capital) can affect pension calculations. Consequently, some people may prefer to keep old entries on record. The draft lets individuals opt out of the automatic cancellation. Applicants will have 30 days to submit a statement rejecting the write-off. Therefore, consider seeking advice before accepting the cancellation. Moreover, update your PESEL (national ID) data and postal address with ZUS. PESEL helps ZUS find your records. In addition, create or log into your PUE ZUS account to see notifications quickly.

💡 GOOD TO KNOW: ZUS is Poland’s Social Insurance Institution. PUE is the online portal to view your records. PESEL is your national ID number. Check your PUE account and the last postal address registered with ZUS. If you may need old contributions for a future pension, consider refusing the write-off within 30 days. Seek help from a tax advisor or your embassy if unsure.

Note that the law would begin on the first day of the month after five months from publication. Therefore, exact timing depends on parliamentary steps. Finally, the bill aims to close cases that date to before ZUS reform in 1999.
