Saw a smaller transfer or got a letter from a bailiff? pension garnishment Poland alarms many retirees and expats who rely on social payments. However, one annual supplement remains untouchable by collectors.

Which extra annual pension is fully protected

The 14th pension, an extra annual payment, enjoys full legal protection. Consequently, the Social Insurance Institution (ZUS) cannot deduct a single złoty. Moreover, the same protection covers the 13th pension. In addition, the law explicitly bars any seizure of those funds. These rules apply even for child support arrears, which the law usually treats more strictly.

Monthly retirement pay follows different rules. Therefore, a bailiff can seize part of a standard pension. For ordinary civil debts, the limit is 25 percent. However, the recipient must keep at least 1,401.57 zł as of March 1, 2026. Moreover, debts for residential care increase the seizure cap to 50 percent. In addition, child support arrears can justify up to 60 percent seizure. Consequently, the protected floor drops to 849.42 zł for such cases.

Why money on a bank account can still be vulnerable

When ZUS transfers money, the bank sees a balance, not a labelled benefit. Therefore funds lose their original identity on the account. Banks and bailiffs then treat the sum as general account money. However, the law creates an exception for payments like the 13th and 14th pensions. In practice, the bank does not automatically know the source. Consequently, a protected transfer can become blocked by mistake.

If that happens, inform your bank and the bailiff. Moreover, show a ZUS transfer confirmation or a benefit decision. In addition, file a bank release request for funds exempt from seizure. If the bank does not act, you can file a complaint about the bailiff’s actions to a court. However, remember that the complaint alone does not stop execution. Therefore, contact ZUS and the bank at once to speed up the refund.

Other fully protected benefits and why they matter

Beyond the two annual pensions, the state protects several other benefits. For example, the care allowance, survivor benefits for orphans, and grants for veterans remain exempt. Moreover, social and family benefits, including the 800 plus child benefit, also stay protected. Therefore receiving these payments will not block eligibility for housing aid or other social help. In addition, these sums do not count toward income tests for other benefits.

💡 GOOD TO KNOW: If you are an expat, register for a PESEL number to simplify correspondence. PESEL is the national ID number. Also register with ZUS (Social Insurance Institution) if you paid contributions here. Moreover, keep ZUS transfer confirmations and your bank statements. Therefore you can prove that a blocked transfer comes from a protected pension. In addition, remember that banks follow strict account seizure rules. However, mistakes still happen, so act quickly and keep copies of all documents.
