Money in ZUS after death: who can claim?

Money in a deceased person’s social account can still be claimed. Many families do not realise that ZUS subaccount inheritance can lead to direct payouts. Consequently, relatives and others should check the Social Insurance Institution records after a death.

ZUS subaccount inheritance: what it means

ZUS stands for Zakład Ubezpieczeń Społecznych, the Social Insurance Institution. Moreover, ZUS manages personal accounts and subaccounts for pension calculation. In addition, some people kept funds in an OFE, an open pension fund. Therefore, the estate may include more than bank savings or a life policy.

Who can receive funds from a subaccount?

The rules depend on family status and prior designations. If the deceased left a spouse, the spouse often receives a share. Moreover, ZUS divides funds gathered during marital community property. Also, the deceased may have named another person. Consequently, that person can get money even if they are not a family member. In addition, if no one received a designation, the funds can join the estate. Therefore, heirs who win the inheritance claim can ask ZUS for payment.

How the procedure works and where to start

If the deceased belonged to an OFE, start at the fund. The fund performs the first division of assets. Afterwards, the OFE must notify ZUS within 14 days. Then ZUS has up to three months to allocate subaccount funds. However, if the person did not belong to an OFE, file directly with ZUS. In that case, use form USS to request transfer or payout. Also, you can submit USS electronically via eZUS. Moreover, prepare documents that prove your claim. For instance, heirs need inheritance proof. Spouses must show marital property regime. Therefore, contact ZUS first to confirm required papers.

Special cases: retirees and guaranteed payments

If the person already received an old age pension, the rules change. For example, ZUS operates a guaranteed payout in some situations. Consequently, it matters whether the retiree died soon after first receiving pension. Also, the calculation can reduce available funds. Therefore, do not assume the subaccount balance equals the payout amount.

Many families do not know which OFE held the account. However, ZUS can release that information to a person with legal interest. Therefore, start enquiries early. Moreover, you do not need a private intermediary. ZUS accepts claims filed directly. Also, ZUS often notifies designated persons after a member dies.

💡 GOOD TO KNOW: If you are an expat, check whether the deceased had a ZUS account or belonged to an OFE. ZUS (Social Insurance Institution) keeps records under the person’s PESEL number (national ID). Consequently, you may request information in person, by mail, or via ePUAP if you hold a Polish trusted profile. In addition, legal heirs should prepare a death certificate and proof of heirship. Therefore, consult ZUS or a local notary to avoid missing an unexpected payout.

Finally, remember that subaccount funds often escape immediate family notice. Therefore, asking the right questions can recover money for those left behind. Moreover, understanding ZUS procedures avoids delays and extra costs.
