Lublin court upholds waste fee method after water meter dispute

Naczelny Sąd Administracyjny upheld Lublin’s method for waste fees based on water use, highlighting the Lublin water meters debate and its impact on residents.

Court decision and the city’s position

The Naczelny Sąd Administracyjny dismissed cassation complaints on July 15, 2026. Consequently, the city method for calculating waste fees in multi-family buildings remains in force. Moreover, Lublin officials said the court confirmed the system’s legality. The deputy mayor, Tomasz Fulara, argued that charging by water consumption is fairer. He added that the system targets people who actually live in flats, not only those listed on declarations.

Lublin water meters: dispute over which meter counts

However, the Robotnicza Spółdzielnia Mieszkaniowa “Motor” raised a different point. It argued the resolution lacked clarity about the source of water readings. In particular, it noted the city did not specify whether to use the building’s main meter or individual flat meters. Therefore, the cooperative feared municipal orders could shift the difference to residents. The cooperative wrote that the gap can reach about ten percent. Furthermore, it cited water used in shared spaces, pipe losses, and meter accuracy as reasons for discrepancies.

What the court actually said and lingering questions

According to RSM “Motor”, the court’s oral justification favoured using local meters in flats. In addition, the court said this interpretation did not make the resolution invalid. The court also warned that annulling the rule after a year would create administrative chaos. Consequently, both the city and cooperatives would face complex re-settlements. Nevertheless, the court rejected complaints about unequal rules for single-family and multi-family housing. The cooperatives remain critical and hope for unified rules in future regulations.

Finally, both sides blamed unclear drafting for the court fight. RSM “Motor” said the city could have avoided litigation by clarifying meter rules. Therefore, better municipal communication could prevent similar disputes elsewhere.
