Government Plans Major ZUS Debt Write-Off

The government has proposed a ZUS debt write-off that could erase more than PLN 315 million in old social contribution debts. Moreover, the plan could affect roughly 7,100 payers across Poland.
ZUS debt write-off: who may qualify
The draft targets liabilities that arose before 1999. Consequently, authorities argue that pursuing those claims lacks economic sense. In addition, the government would exclude debts secured by a mortgage. Therefore about 3,800 payers would not see cancellation because a property lien increases recovery chances.
Numbers, reasons and process
The Ministry of Family, Labour and Social Policy prepared the draft law. It aims to remove historical cases from the Social Insurance Institution records. ZUS (Social Insurance Institution) still runs recovery efforts. However it recovers only about PLN 4 million yearly from these old claims. Moreover much of that amount comes from interest, not the principal debt. Consequently administrators say they spend more on enforcement than they get back. Therefore the proposal would allow automatic cancellation by law. In practice ZUS would not need to issue thousands of individual decisions. In addition payers would not need to file applications to benefit. However the draft would let a payer opt out. Thus an individual could file a statement to refuse the automatic write-off.

If you owe contributions, check two facts. First identify when the debt arose. Second check whether ZUS holds a mortgage on your property. Moreover confirm whether interest now forms most of the claim. In addition remember the proposal covers only debts created before 1999. Therefore liabilities from recent years remain outside this relief. However do not assume cancellation until the parliament passes the law. The draft must clear the Cabinet and the legislative process. Consequently you should continue to meet current legal obligations for now.

The government will discuss the draft in the Council of Ministers next. Moreover the text can change during parliamentary debate. Therefore affected people should not stop payments now. In addition property owners with liens should prepare for continued enforcement. However thousands of small historical cases could close if lawmakers approve the plan.
